Man shot, killed during struggle with police over Taser at Wendy’s, GBI says

The Georgia Bureau of Investigation says a man has died after a shooting involving police at a local Wendy’s.

Videos of the scene have been circulating on social media.

Atlanta Police Department responded to the fast food location off University Avenue around 10:33 p.m. Friday night.

The GBI says officers received a complaint about a man sleeping in a car in the drive-thru and cars having to drive around him.

Officers performed a field sobriety test on the man. The GBI says he failed the test and officers started to place him into custody.

He resisted and a struggle happened over a Taser, according to witness reports.

“During the arrest, the male subject resisted and a struggle ensued. The officer deployed a Taser. Witnesses report that during the struggle the male subject grabbed and was in possession of the Taser,” the GBI said. “It has also been reported that the male subject was shot by an officer in the struggle over the Taser.”

A video on social media appear to show the man running from police when he was shot. Channel 2 Action News is working to confirm that this video is connected to the case.

The man was taken to a hospital, where he died after surgery. The GBI identified him as 27-year-old Rayshard Brooks of Atlanta.

An officer was treated for an injury and discharged from the hospital.

The investigation is ongoing and GBI will hand the case over to the Fulton District Attorney’s Office when it is done.

This is the 48th police shooting the GBI has investigated in 2020.
