NYC teen files a lawsuit against NYPD for $5Million after being punched repeatedly and trampled by NYPD!

NYPD and subways have been causing a lot of chaos lately. 15-year-old Benjamin Marshall is filing a $5 million lawsuit after being punched in the head and trampled by several officers in Jay Street subway station in New York City.

 

Marshall was wrongfully accused of being apart of a brawl and lashing out on an officer. Benjamin happened to be caught up at the wrong place at the wrong time while trying to retrieve his book bag from a friend near the melee. Benjamin Marshall attends The Science Skills Center High School and was one of the five teens arrested in the viral video that took place on Friday afternoon.

 

“While he went down into the train station, there were a lot of cops, a lot of students,” said Benjamin’s dad, Anthony Noel, 53. “They were arresting a couple of people. When he got down on the platform, one of his friends called out to him, and when he looked over, he got punched multiple times by a police officer in his head. Then he was slammed to the ground.

 

“About six of them or eight of them were on top of him. One put his knee in his neck. He kept saying, ‘I can’t breathe, I can’t breathe,’ and they would not let up. They handcuffed him. Slammed him into a sign.”

 

This case has a lot of promising details, including the fact that Marshall wasn’t able to receive medical attention until 2 a.m. about 6hrs after the incident. Benjamin was charged as a juvenile with assaulting a police officer and the family’s lawyer, Sanford Rubenstein is not in favor of this decision he claims, “This police officer’s actions were out of control … He was not part of or involved in the melee that was ongoing at the train station. For a police officer to punch a 15-year-old in the face when he was doing nothing wrong is simply unacceptable.”
