A seemingly unimportant tattoo may have brought more legal trouble for Cardi B, as a judge has denied a motion to dismiss the lawsuit of someone who claims that Cardi stole his likeness.

On the cover of Cardi’s mixtape, Gangsta Bitch Music Vol. 1, Cardi is depicted drinking a 40 ounce of Olde English and getting head from a man with a tattoo of a tiger and a snake on his back. According to Billboard,  Kevin Brophy Jr., who currently works for a surfing and lifestyle company, has never met Cardi, but claims that she stole his likeness by copying his tattoo for the mixtape cover.

Brophy claims that because his job requires him to be shirtless often, he’s become recognizable for his tattoo, which he claims is the only one in the world of its kind. He also alleges that the cover shows depicts him in a submissive and embarrassing position, and that the usage of his tattoos on the cover is a copyright violation.

While Brophy originally brought the suit to Cardi back in October, Cardi brought a motion to dismiss the case last month, demonstrating that the individual in the photo is, in fact, not Brophy, the Judge has opted not to dismiss the case, citing questions about where to properly litigate the case. Cardi’s attorney said that the case was just a ploy to make some money off a rich celebrity, and he may be right, since Brophy is seeking $5 million in damages.
