The $38 million awarded to Korryn Gaines’ family via a wrongful death verdict has been overturned by a Baltimore County Circuit Court Judge.

A police officer killed 23-year-old Korryn Gaines and wounded her 5-year-old son in 2016 in Randallstown, MD. After her death, Gaines’ family filed a wrongful death suit claiming officers used excessive force against the 23-year-old and her 5-year-old son Kodi, who was wounded during the tragic incident. The jury eventually sided with the family and they were awarded $38 million in damages; $33 million to Kodi, $4.5 million to her daughter, Karsyn, and $9,000 to her parents and estate.

A year later, Baltimore County Circuit Court Judge, Mickey Norman, decided to dismiss the claims made against Corporal Royce Ruby Jr., who fatally shot and killed the young mother.

According to The Baltimore Sun, Maryland judge, Mickey Norman, denied the jury’s finding last year and the officer who shot Gaines acted reasonably. The judge said in his ruling that the officer, Royce Ruby, was “entitled to qualify immunity”, a legal doctrine shielding cops and government officials from civil liability since he was acting in his capacity as a police officer.
