A man from Santa Fe, New Mexico is reportedly suing Dave Chappelle for an alleged assault. According to KOB4, Christian Englander — who was arrested for throwing a banana peel at the comedian at the Lensic Performing Arts Center in 2015 — says he was actually the victim.
In a new lawsuit filed by Englander, he alleges Chappelle directed his bodyguard to strike him twice in the face, without provocation.
Englander also says in the suit that Chappelle showed up at the Santa Fe police station to question Englander and “Defendant Chappelle advanced towards Plaintiff, still restrained by handcuffs, in a sudden and frightening fashion that placed Plaintiff in fear.”
Englander was charged with battery and disorderly conduct.
Video footage of the 2015 incident shows Englander throwing a banana peel at Chappelle. He was reportedly angry that Chappelle was making fun of his friend but the comedian believed the action was racially motivated.
After the incident, Englander— who calls himself the “gypsy joker jester” — did an interview with Albuquerque’s KRQE 13 denying he was a racist while offering an apology to Chappelle.
Charges against Englander were eventually dropped after Chappelle failed to get back to authorities.
A police report filed after the 2015 incident doesn’t mention the alleged assault.
